Mẫu đơn đề nghị xem xét theo thủ tục tái thẩm được ban hành kèm Nghị quyết 01/2017/NQ-HĐTP Danh mục 93 biểu mẫu mới dùng trong tố tụng dân sự.
Tái thẩm là gì? Nên hiểu như thế nào?
Tái thẩm là việc xét lại bản án, quyết định đã có hiệu lực pháp luật nhưng do các đương sự kháng nghị khi phát hiện ra tình tiết mới có thể làm thay đổi nội dung cơ bản của bản án, quyết định mà trước đó khi Tòa ra bản án các đương sự không biết.
Do đó, có thể hiểu, khi một bản án, quyết định đã có hiệu lực mà sau đó phát hiện tình tiết mới có thể thay đổi nội dung của bản án, quyết định đó thì có thể yêu cầu Tòa án có thẩm quyền xem xét theo thủ tục tái thẩm.
Nội dung được quy định tại Điều 351 Bộ luật Tố tụng dân sự 2015.
Khi nào được xem xét theo thủ tục tái thẩm?
Như vậy, theo Điều 352 Bộ luật Tố tụng dân sự 2015, khi có các căn cứ sau đây thì Tòa án sẽ xem xét lại bản án, quyết định theo thủ tục tái thẩm:
– Phát hiện tình tiết mới, quan trọng mà trước đó trong quá trình giải quyết vụ án, các đương sự không thể biết
– Có cơ sở chứng minh kết luận giám định, lời dịch không đúng sự thật hoặc bị giả mạo chứng cứ
– Thẩm phán, Hội thẩm nhân dân, Kiểm sát viên cố ý làm sai lệch hồ sơ hoặc cố ý kết luận trái pháp luật
– Bản án, quyết định của Tòa án hoặc cơ quan nhà nước mà Tòa căn cứ để giải quyết bị hủy bỏ
Lúc này, phải làm đơn đề nghị gửi cơ quan có thẩm quyền để đề nghị xem xét theo thủ tục tái thẩm. Theo đó, trong đơn đề nghị phải có cơ bản các nội dung sau đây:
– Họ tên, địa chỉ liên hệ, tư cách tham gia tố tụng của người đề nghị
– Tên, số hiệu, ngày cấp của bản án, quyết định
– Yêu cầu của người đề nghị
– Các tài liệu, chứng cứ kèm theo để chứng minh cho đề nghị của mình là đúng.
